How to request your personal information

Where you are seeking a copy of your personal information please:

On receipt of your request, we will always send you a written acknowledgement and may need to ask you for:

  • proof of identification if you have not supplied this already (copies of utility bills, driving licence or similar)
  • information about the nature of your request and your dealings with us so we can understand, identify and locate information that is relevant where this is not already clear from your request. 

If we do not hear back from you with confirmation of your identity and/or sufficient information to respond to your request within 2 weeks, we will not be able to process your request and it will be treated as lapsed for accounting purposes.

To assist you in your request, we have defined the meaning of personal information, which could include personal data and/or sensitive personal data.

Personal data is information relating to an identified or identifiable natural person (‘data subject’). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Sensitive personal data or special category personal datais data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data concerning health or data concerning a natural person’s sex life or sexual orientation and genetic data or biometric data for the purpose of uniquely identifying a natural person

You may authorise someone else to get personal information for you, but they must provide clear evidence that they have been given permission by you.

We aim to respond to each request within the 1 calendar month legal limit from the day after we have received your written request.

This period may be extended by two further months where necessary, should the complexity and number of the requests determine this is required. If this is the case we will write to you to inform you of any such extension within one month of receipt of the request, together with the reasons for the delay.

Information we hold about you

The General Data Protection Regulations and the Data Protection Act 2018 deals with information held about living individuals. This legislation gives the data subject (the person the data is about) certain rights regarding their personal data. Under the General Data Protection legislation we must comply with the six principles (a-f) when handling personal information.

Additional rights you may have in relation to your personal data are included in our Privacy Policy. This will include further details about your rights for:

  • Accessing your personal data
  • Rectifying or erasing your data
  • Reviewing any automated decision making
  • Registering your objection to the processing of data
  • Restricting the processing of your data
  • Your right to data portability
  • Your right to withdraw consent

Why we record your details

Your personal information is held by us and other organisations to help us work more efficiently together on your behalf.

The information we hold could help us see if we can offer you a service, to make sure you receive the best care, to help us plan and develop future services and to keep a record of what we have talked with you about regarding your concerns, care and needs.

Information we share with others

Some of the information we hold is sensitive and personal. Under the legislation we have a duty to protect your records and keep what you tell us safe.
Our staff, and people who work closely with us, value your rights to keep your information confidential and only to let other professionals know when they have a clear need to as part of their job.

In some circumstances we are obliged to show information to others. This would include when a person or an organisation has a legal right to the information, such as health professionals or the police.

Costs of requests

Requests for information relevant to you are free of charge.

The only exception to this would be where requests from a data subject are manifestly unfounded, excessive or repetitive. In those circumstances the Council may charge a reasonable fee taking into account the administrative costs of providing the information. Alternatively the Council may choose to refuse to act on the request.

Where possible the Council will provide guidance and assistance to support your request for information.
