A PSPO in relation to dog control is in effect across Blackburn with Darwen Borough to create a more comprehensive and consistent approach when dealing with issues such as dog fouling, keeping dogs on leads and excluding dogs from specified areas.
The Council believes that the Dog Control PSPO will address the anti-social behaviours of a small minority of dog owners that can have a detrimental effect on the quality of life for the residents of Blackburn with Darwen. Unless these anti-social activities are addressed they will continue and the Council believes that would be unreasonable. The Council receives a great many complaints about dog control, which includes fouling, dogs off a lead that are out of control, dogs inside children's play areas and dogs off leads in cemeteries. The PSPOs will also act as a deterrent and send the message that Blackburn with Darwen will tackle anti-social behaviour.
Authorised Officers will have the powers to prevent anti-social behaviour in relation to dogs and to help promote responsible dog ownership.
The Dog Control PSPO requires:
Dogs owners to remove dog faeces
Requires dog owners to remove dog faeces and this applies to any land to which is open to the air and to which the public have access, see Schedule 1.
Dogs to be kept on leads in cemeteries
The Dogs on Leads (Blackburn with Darwen) Order 2018. The effect of this Order is to make it an offence if a dog in your charge is not on a lead in a cemetery/burial ground. This Order applies only to any cemetery listed in Schedule 2.
Excludes dogs from children’s play areas
The Dogs Exclusion (Blackburn with Darwen) Order 2018. The effect of this Order is to make it an offence if a dog in your charge enters a children’s play area. This Order applies to only any children’s play area listed in Schedule 3
If any of the conditions are breached a Fixed Penalty Notice of £100 can be issued and failure to pay may lead to prosecution and being liable on summary conviction to a fine not exceeding Level 3 (currently £1,000) on the standard scale.
The Orders will have effect for three years and runs from 18th January 2018 until 17th January 2021.
